Terms of Service

Welcome to Pastify AI. These Terms of Service ("Terms") govern your access to and use of the Pastify.ai website, our AI-powered resume generation platform, and all related services (collectively, the "Service"). These Terms constitute a legally binding agreement between you ("You", "User") and Pastify.ai ("we," "us," or "our").

By creating an account, making a purchase, or using our Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

1. Eligibility and Account Registration

You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service. By agreeing to these Terms, you represent and warrant that you meet this age requirement. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are solely responsible for all activities that occur under your account and for safeguarding your password. You may not sell, transfer, or assign your account to any other person.

2. The Service and Grant of License

Pastify.ai provides an AI-driven platform to assist users in creating professional resumes and related job application materials. The Service may be offered under various subscription plans or usage-based models (e.g., Starter, Popular, Professional, Ultimate plans).

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for your personal, non-commercial job-seeking purposes.

3. User Content and Intellectual Property

3.1. Your User Content

You retain full ownership of the personal data, employment history, and any other information you submit to the Service ("User Content"). However, to enable us to provide the Service, you grant Pastify.ai a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and create derivative works from your User Content solely for the purpose of operating, providing, and improving the Service for you.

3.2. AI-Generated Content

The Service uses your User Content to generate text and analysis ("Generated Content"). We grant you a license to use the Generated Content for your personal job-seeking activities, such as including it in your resume for job applications. You may not represent the Generated Content as your own original work without modification and are responsible for reviewing and verifying its accuracy. You may not use the Generated Content for any commercial purpose, such as reselling the text.

3.3. Our Intellectual Property

The Service, including its underlying AI models, software, design, branding, and all original content (excluding User Content and Generated Content), are the exclusive property of Pastify.ai and its licensors, protected by copyright, trademark, and other intellectual property laws.

3.4. Feedback

If you provide us with any suggestions, ideas, or feedback, you grant us the right to use it without any restriction or compensation to you.

4. Payments, Credits, and Refunds

Certain features of the Service require the purchase of credits or a subscription plan. All financial transactions are processed through our third-party payment processor, Creem.io ("Creem"). By making a purchase, you agree to Creem's terms and conditions. We are not responsible for the performance or security of Creem.

Purchased credits are for use only on the Pastify.ai platform, have no cash value, are non-transferable, and non-refundable. All purchases are final except as required by applicable law or as outlined in a specific promotional offer. We reserve the right to change our prices at any time.

Service Guarantee: If our AI generation service fails to produce results due to technical issues or system errors, the credits consumed for that failed generation will be automatically refunded to your account. This does not apply to cases where you are dissatisfied with the quality of successfully generated content, as content quality is subjective and you are responsible for reviewing and editing generated materials before use.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Upload or generate any content that is unlawful, fraudulent, defamatory, obscene, or hateful.
  • Submit false, misleading, or inaccurate information in your User Content.
  • Infringe upon the intellectual property or privacy rights of any third party.
  • Attempt to decompile, reverse engineer, or otherwise discover the source code of our Service or AI models.
  • Use any automated means (e.g., bots, scrapers) to access the Service or extract data for any purpose, including for training AI models.
  • Disrupt the security or integrity of the Service, or transmit any viruses or malicious code.
  • Use the Service to build a competitive product or service.

6. Termination

We may suspend or terminate your access to the Service at our sole discretion, without prior notice, for any reason, including a breach of these Terms. You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination, your right to use the Service ceases, and we may delete your account and User Content. Sections on Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law shall survive termination.

7. Disclaimers and Limitation of Liability

7.1. "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR SUITABILITY OF THE GENERATED CONTENT. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING, EDITING, AND VALIDATING ANY CONTENT BEFORE USE. YOUR RELIANCE ON ANY INFORMATION PROVIDED BY THE SERVICE IS AT YOUR OWN RISK.

7.2. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PASTIFY.AI, ITS AFFILIATES, OR THEIR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

8. Indemnification

You agree to defend, indemnify, and hold harmless Pastify.ai and its employees, directors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including any intellectual property or privacy right.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of [Your Country/State], without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration association, and you agree to waive your right to a jury trial and to participate in any class action lawsuit.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
